1. Acceptance of terms
By accessing or using Presentr Analyze ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including individual accounts and organization members.
2. Description of service
Presentr Analyze is a media analysis platform that processes video and audio files to produce transcriptions, translations, ad break detection, chapter segmentation, and related analysis outputs. The Service is operated by T3 Interactive.
3. Accounts
You must provide accurate information when registering. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately if you suspect unauthorized access.
We reserve the right to suspend or terminate accounts that violate these terms, engage in abuse, or remain inactive for an extended period.
4. Acceptable use
You agree not to:
- Upload, transmit, or otherwise submit content that you do not own or do not have a written licence or other valid legal right to process. This includes commercial audio, video, images, or transcripts where the underlying work is owned by a third party.
- Use the Service to circumvent paywalls, digital rights management, or geographic licensing restrictions.
- Use the Service to process content that is unlawful in the jurisdiction in which you reside or in which the underlying work was produced.
- Use the Service to process content that depicts minors in a sexually explicit manner, content that promotes terrorism or incites violence, or content that violates any applicable export-control or sanctions law.
- Attempt to circumvent usage limits, access controls, content moderation gates, billing flows, or attestation requirements.
- Reverse-engineer, scrape, or abuse the API in a manner that degrades service for other users, or attempt to extract user data belonging to other accounts.
- Use the Service to generate spam, disinformation, harassment, or synthetic media intended to deceive a viewer about its origin or to impersonate a natural person without that person's consent.
We reserve the right to suspend or terminate accounts, void unused credits, and refuse processing for any content that violates this section, with or without prior notice and without refund of fees paid for the affected processing.
5. Your content
You retain ownership of all media files and content you submit to the Service ("Your Content"). By submitting Your Content, you grant T3 Interactive a limited, non-exclusive, royalty-free, worldwide licence to host, store, transmit, process, and analyse Your Content solely to provide the Service to you and to your designated organisation members.
You represent and warrant that, with respect to each item of Your Content submitted:
- you own all rights necessary to upload and process the content, or you hold a valid written licence or other lawful authorisation from the rights holder that permits the processing you instruct the Service to perform;
- the content does not infringe any third party's intellectual property, privacy, publicity, or other legal right;
- the content does not depict any identifiable person in a sexually explicit manner without that person's documented consent;
- you will not instruct the Service to perform any analysis that would result in a violation of the clauses above.
For uploads flagged by the Service's content moderation systems as potentially containing explicit material or material that is commonly distributed without licence, you may be asked to re-affirm these representations through an in-product attestation before the Service will continue processing. Acceptance of that attestation creates a durable audit record that includes the acceptance timestamp, your account identifier, the attestation version, and the IP address from which the attestation was submitted.
We do not use Your Content to train AI models, and we do not share Your Content with any third party except (i) the sub-processors listed in our Privacy Policy and (ii) where disclosure is compelled by law or a valid legal process.
6. Intellectual property
The Service, including its software, design, and documentation, is owned by T3 Interactive and protected by intellectual property law. You may not copy, modify, or distribute any part of the Service without written permission.
7. Billing and payment
Paid plans are billed in advance on a monthly or annual cycle. All fees are non-refundable except where required by law. We reserve the right to change pricing with 30 days' notice. Continued use after a price change constitutes acceptance.
If a payment fails, access to the Service may be suspended until the balance is resolved.
8. Third-party integrations
The Service integrates with third-party platforms including Google Drive, Dropbox, and YouTube. Your use of those integrations is subject to the respective providers' terms of service. We are not responsible for changes to or outages of third-party services.
9. Disclaimer of warranties
The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that analysis outputs will be accurate. Transcription and AI analysis results should be reviewed before reliance.
10. Content moderation
We operate automated content-signal systems that scan uploaded filenames, titles, and content fingerprints (hashes) at upload and dispatch time. These systems are designed to identify content that may violate Section 4 (Acceptable Use), Section 5 (Your Content), or applicable law. The systems may classify content as one of the following:
- Clear — processed normally;
- Requires attestation — paid users may proceed after affirming the representations in Section 5 through the in-product attestation flow; free-plan users are blocked;
- Blocked — content matching a known restricted fingerprint or producing a hard-block signal is refused for all plan tiers; the upload will not be processed and any reserved credits will be released.
These classifications are not warranties of legality, accuracy, or rights ownership. A "clear" classification does not transfer to you any right or licence in the underlying content. A "blocked" classification does not constitute a determination that the content is unlawful; it reflects our product policy, which is independent of legal status.
We may add, remove, or modify content fingerprints in our restricted list, and we may revise the classification of any upload at any time, including retroactively, based on takedown notices, complaints, or our own review.
You may not attempt to evade these classifications by altering filenames, titles, or file metadata, or by re-uploading content under different account identifiers.
11. Explicit and adult content
The Service may be used to process explicit or adult content only under the following conditions:
- you are on a paid plan;
- you have re-affirmed the representations in Section 5 through the in-product attestation flow for the specific upload being processed;
- the content depicts only adults of legal age in the jurisdiction in which the content was produced and in your jurisdiction of residence, and you have records of age and consent for each identifiable person depicted, available upon request;
- the content does not violate any law applicable in either of those jurisdictions, including but not limited to laws governing distribution and processing of explicit material.
Explicit content is not available for processing on the free plan, regardless of attestation. Free-plan uploads that the content-moderation system classifies as potentially explicit will be refused; the upload will not be processed and no credits will be deducted.
The Service does not warrant the legality, accuracy, or appropriateness of explicit content classifications. You remain solely responsible for ensuring that your use of the Service complies with all applicable laws.
12. Limitation of liability
To the maximum extent permitted by law, T3 Interactive shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim shall not exceed the amounts paid by you in the 12 months prior to the claim.
13. Changes to terms
We may update these terms from time to time. We will notify you of material changes by email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the revised terms. When the in-product attestation language changes, existing users may be prompted to re-accept the updated terms before continuing to process flagged content; prior acceptances are retained for audit purposes.
14. Governing law
These terms are governed by the laws of the jurisdiction in which T3 Interactive operates, without regard to conflict of law principles.
